National Seminar on
“Issues and Challenges in Implementation of New Criminal Laws”
Sardar Patel Subharti Institute of Law in collaboration with Dr. Ambedkar Chair, Swami Vivekanand Subharti University Meerut organized a National Seminar on “Issues and Challenges in Implementation of New Criminal Laws” on 09/11/2024. Total 146 participants presented their research papers. Total ten participants out of 146 were from other states too. National seminar was divided into three sessions.
Inaugural Session
During the inaugural session, at the outset of Seminar, Ms Gracy Chaudhary, Ms Ankita Singh, Students of BA.LL.B 5th year and Ms Prakriti welcomed all the Participants present in Sardar Patel Auditorium. After that the Hon’ble Guest was invited to the Dias. The master of ceremony, Ms Gracy Chaudhary and Ms Ankita Singh welcomed the guest by offering a good luck plant to the guest of the seminar. Thereafter guests were invited for the lamp lighting ceremony. During the seminar, the Hon’ble Guest was introduced by Ms Prakriti Students of BA.LL.B 4th year.
After formal welcoming of the guest and the participants, the opening speech was delivered by Prof. (Dr.) Reena Bishnoi, Professor, Faculty of Law & Chairperson, ICC, SVSU, Meerut. Prof. (Dr.) Reena Bishnoi, Chairperson, ICC, SVSU also welcomed the Hon’ble Dignitaries of the seminar. During her opening speech, she highlighted the reasons and objectives for enacting three new criminal laws by Parliament. After the opening speech of the seminar Adv Mr. Saju Jacob (Lily Thomas Chambers), Advocate, Supreme Court of India & Solicitor (UK) delivered his speech on the necessity of new criminal laws introduced by Parliament. During his Lecturer he said that no one is above the law. He said that we have a number of challenges in implementation of new criminal laws. The use of information technology is essential for the implementation of new criminal laws which may pose a threat to the rights to privacy, data leak, manipulation of digital record and evidence. In his concluding remarks he said that despite various challenges of implementation of new criminal laws, we should accept the positive changes made by new criminal laws because our history is the history of moral change. He also said that digitalization of the criminal Justice system is the need of time. Towards the end he mentioned that the constant change is the rule of nature, hence we should accept the changes of new criminal laws wholeheartedly.
After that Prof. (Dr.) Vageshwari Deswal, Professor, Faculty of Law, University of Delhi, New Delhi delivered her speech. During her speech she said that changes are a very necessary part of life. In new criminal law there is the change from penal to Justice in Bhartiya Nyaya Sanhita, 2023. She said that re-arrangement of the sections of IPC is very important under the Bharatiya Nyay Sanhita. There is a paradigm shift in various provisions of our criminal laws through new criminal laws. Many progressive changes have been made by new criminal laws such as the concept of movable property, concept of community services, gender neutrality of offenses etc.
The redundant provisions of old criminal law have been deleted. She also highlighted the new type of crime introduced by Parliament through New Criminal Laws.
After that Prof. (Dr.) Asad Malik, Professor, Faculty of Law, Jamia Millia Islamia University, New Delhi delivered his speech. During his speech, he said that changes introduced by Bhartiya Nagrik Suraksha Sanhita are very important for making our criminal system progressive. The changes in the process of investigation are important here. The complainants or victims can lodge zero from anywhere. The investigative agencies are bound to make the investigation in a time bound manner. Changes made in the provisions for police remand are very important. The accused cannot take excuses of illness because the investigative agencies have sufficient power and time for demanding the police remand from the Magistrate. He also said that the concept of preliminary inquiry was introduced by BNSS. Courts are bound to complete the trial in a time bound manner. He also said that Courts are bound to upload their judgments on websites within 7 days which is a good step.
After that Prof. (Dr.) Amar Prakash Garg, Director Research, Applied Sciences, SVSU & Former Vice-Chancellor, Shobhit Institute of Engineering & Technology,(Deemed-to-be-University) delivered his speech. He pointed out that the Britishers made rules to rule us not for the purpose of rule of law and hence it was the need of the time to get new criminal laws for India by which we the people of India can benefit. He suggested that all stakeholders should come together and make these new laws a success and we should pledge to educate the society with these new laws. Moving forward, Hon’ble Vice- Chancellor, Maj. Gen (Dr.) G K Thapliyal, SM (Retd.), SVSU addressed participants present in the hall. He said that both the term Bharat and India have been used in our constitution of India. He said that Article 1, Clause 1 of the Constitution of India provides that India that is Bharat shall be a Union of States. He said that the term Bhartiya which is used in the title of new criminal laws is more appropriate and more closed to our consciousness. He said that it is a good step for positive changes for our indigenous criminal Justice system.
In the last, the inaugural session was ended with the formal vote of thanks by the convener of the seminar Prof. (Dr.) Vaibhav Goel Bhartiya, Dean Faculty of Law.
Technical Session-1
Bhartiya Nyaya Sanhita, 2023
Technical Session-1 of the seminar was chaired by Dr. Ajay Raj Singh, Ms Afreen Almas. During technical session-1, a total of 20 participants presented their research in the seminar. The technical session-1 was conducted by Mr. Yuvraj, students of BA.LL.B. 1st Year.
Technical Session-2
Bhartiya Nagarik Suraksha Sanhita, 2023
Technical Session-2 of the seminar was chaired by Dr. Sarika Tyagi and Dr. Prem Chandra. During technical session-2, 19 participants presented their research in the seminar. The technical session-2 was conducted by Ms. Zahira, students of BA.LL.B. 1st Year.
Technical Session-3
Bhartiya Sakshya Adhiniyam, 2023
Technical Session-3 of the seminar was chaired by Ms Ana Sisodia and Ms. Sonal Jain. During technical session-3, 19 participants presented their research in the seminar. The technical session-3 was conducted by Ms. Kumari Preet, students of BA.LL.B. 1st Year. Valedictory Session
At the end of the National seminar valedictory session was conducted. The valedictory session was chaired by Prof. (Dr.) Vaibhav Goyal Bhartiya, Prof. (Dr.) Amar Prakash Garg, Dr. Anuradha Asthana Singh. During valedictory session Prof. (Dr.) Vaibhav Goyal Bhartiya said in his speech that it is a matter of great joy that this one-day seminar was attended by participants from ten states, Uttar Pradesh, Rajasthan, Delhi, Haryana, Kashmir, Madras, Orissa, Karnataka, Madhya Pradesh and North Bengal. While thanking all the guests, speakers and audience, he said that by this national seminar all the participants would have definitely benefited a lot. Prof. (Dr.) Amar Prakash Garg said in his speech that justice should be provided by our system at the door of the people. He said that cheap and speedy Justice is the need of time.
At the end of the program, the formal vote of thanks was delivered by Dr. Anuradha Asthana Singh, Assistant Professor, Sardar Patel Subharti Institute of Law.
