EXPERT TALK on The Bhartiya Nyaya Sanhita-2023 was delivered by Dr. J.D. Upadhyay. He said that the Bhartiya Nyaya Sanhita (BNS), 2023, is one of the three landmark legislations introduced to overhaul India’s colonial-era criminal laws. It replaces the Indian Penal Code (IPC), 1860, aiming to reflect contemporary Indian values, constitutional morality, and public justice over colonial priorities. Language & Structure have been simplified. Reduces colonial influence and reflects Indian jurisprudential thought. New Offences such as mob lynching have been introduced. Offences of organized crime & terrorism include provisions aligned with modern security needs. Hit and Run cases have stricter penalties and procedural clarity. Abolition of Sedition Law Section 124A of IPC replaced with a broader offence of “acts endangering sovereignty, unity, and integrity.” Gender-Neutral Language focuses on gender equity, especially in provisions related to sexual offences. Stricter penalties and enhanced punishments for crimes against women and children, such as rape, gang rape, and custodial crimes have been introduced. In concluding remark he said that the Bhartiya Nyaya Sanhita, 2023, is a transformative legal document, poised to reshape India’s criminal justice landscape. Its success lies not just in legislation, but in thoughtful implementation, judicial interpretation, and public participation.
